Qwest Right of Way Litigation
Corr Cronin represents Qwest Communications Corporation in a series of class action lawsuits filed across the country which challenge Qwest’s right to install its fiber optic cable in railroad rights of way. Some of the lawsuits seek statewide classes, others seek multi-state classes and a few seek nationwide classes. We have most recently defeated a multi-state class that was brought in the Northern District of Illinois (McDaniel v. Qwest) and a state-wide class that was brought in South Carolina (Sustainable Forest v. Qwest). In both instances, the courts agreed with our arguments that the named plaintiffs’ claims were not common or typical of the class and that individual issues predominated rendering the cases unmanageable.
