Practice Overview

Kelly’s practice focuses on high-stakes commercial litigation, products liability matters, and catastrophic personal injury defense.  Kelly has also developed expertise in insurance coverage and indemnity disputes, and has represented both policyholders and insurance carriers in resolving high-value disputed claims.  Kelly applies his experience as a federal law clerk to forge creative and effective solutions to a wide range of civil disputes.  Since joining Corr Cronin in 2012, Kelly has had significant experience in a wide range of disputes in Washington’s state and federal courts and in alternative dispute resolution forums, having served as an active part of the defense team in several trials, argued and won numerous motions in Washington’s state courts, and obtaining favorable settlements in a number of mediations.  Prior to Joining Corr Cronin, Kelly served as a law clerk to the Honorable Edward F. Shea in the U.S. District Court for the Eastern District of Washington.  Kelly was named a “Rising Star” by Washington Law & Politics Magazine for 2016 and 2017.

Kelly is active in the Seattle community, serving as Legal Chair of the Board of Directors of the Blue Ridge Neighborhood Club and volunteering for the King County Bar Association Neighborhood Legal Clinics.  Kelly is also the author of two published guidebooks to nationally-recognized climbing areas in Washington.  He currently serves on the Board of Directors of the Washington Climbers’ Coalition, a nonprofit organization that promotes and protects climbing access across the state.

Kelly is a graduate of Dartmouth College and the University of Washington School of Law (high honors), where he served as an Executive Editor on the Washington Law Review and was admitted to the Order of the Coif.

Kelly is licensed to practice in Washington state courts, the Western and Eastern Districts of Washington, and the Ninth Circuit Court of Appeals.

Representative Cases

  • SEC v. Path America LLC, et al. – Retained by Seattle-based immigration attorney to represent more than 100 Chinese investors in large-scale Puget Sound real estate projects frozen by allegations of securities fraud by the SEC. Kelly helped recover recovered more than $11 million in frozen investor funds in a case that garnered local and national attention.
  • Godfrey v. Ste. Michelle Wine Estates Ltd. et al. – Kelly was part of a trial team that successfully defended product liability action in Washington state court, resulting in a complete defense verdict after a four-week trial.
  • Doe v. Insurance Company – Kelly brought suit against a specialty environmental insurance carrier to obtain coverage for several large-scale class actions brought against a Puget Sound composting company, obtaining a highly favorable confidential settlement that included payment of all remaining policy limits and the firm’s attorney’s fees and costs.
  • Telecommunications Carrier v. Insurance Company – Kelly brought suit against a specialty professional liability provider to obtain coverage and indemnity for an eight-figure regulatory fine imposed by the FCC. Obtained a very favorable confidential settlement.
  • Doe v. Medical Device Manufacturer – Kelly served as local counsel for an international medical device manufacturer in a high-stakes infant wrongful death suit. Kelly took depositions, drafted motions, and prepared trial materials that enabled the client to settle matter favorably less than one month before trial.
  • Utility Contractor v. Mason County PUD No. 3, et al. – Kelly brought suit on behalf of public utility contractor seeking to enjoin the release of proprietary and confidential bid on Automated Metering Infrastructure contract under the Washington Public Records Act. Kelly obtained a temporary restraining order and negotiated the complete withdrawal of records request on expedited basis.
  • Hauge v. Ash Grove Cement Co., et al. – Kelly was part of the trial team in a lawsuit brought by a worker who had been “buried alive” in industrial accident at a Seattle cement plant. Kelly drafted motions and trial materials that enabled the client to reach a favorable settlement on the eve of anticipated five-week trial.
  • Merriman v. Winners 3, LLC, et al. – Kelly obtained summary judgment dismissal of a premises liability action involving allegations of permanent disability. The third-party indemnification claim against Kelly’s client was dismissed with prejudice and the client was awarded its attorneys’ fees and costs incurred in defending entire matter.
  • Wuth v. Laboratory Corp. of America, et al. – Kelly was part of trial team that defended a unique and controversial “wrongful life” action in King County Superior Court over an eight week trial in the fall of 2013.
